CHAPTER I: GENERAL REGULATIONS

Article 1. Purpose of Alair Virtual Airlines

  1. 1.1 Alair Virtual Airlines is a non-profit virtual entity, whose purpose is the promotion, practice and encouragement of Flight Simulation.
  2. 1.2 Alair Virtual Airlines does not develop any kind of commercial activity nor is it related, in any way, with any real-life airline, so all its activity is limited, virtually, to the recreation of its flight operations within the "International Virtual Aviation Organization" (IVAO) network.
  3. 1.3 Alair Virtual Airlines performs its flight operations under the callsign XAS and will answer its calls under the name of Alair Virtual.
  4. 1.4 Alair Virtual Airlines has its domain registered as www.alairvirtual.es which will be understood as its official website.

Article 2. General Rules

  1. 2.1 Maximum respect is required among all members of the company. No disrespect will be allowed among colleagues.
  2. 2.2 It is not allowed to publish political or religious content in any of the company's communication channels.
  3. 2.3 It is strictly forbidden to publish content of a sexual nature in any of the company's media.
  4. 2.4 The impersonation of any driver by any other person is not permitted.
  5. 2.5 The publication of passwords to third parties is not allowed, since the contents created for the company are exclusive.
  6. 2.6 The following are established as official communication channels: Website, email, Ventrilo channel and Discord channel. The latter will only be used when the Ventrilo channel is down or cannot be accessed due to technical problems. These channels will be used by the staff to communicate with the rest of the pilots.
  7. 2.7 Likewise, Whatsapp, Facebook and any other social network that the staff may decide to implement at the time are established as unofficial channels. Except for Whastapp, the rest of the unofficial channels will be used for the promotion of the Company, as well as its events, online and in-person activities, training, etc.

 

CHAPTER II: OPERATIONAL REGULATIONS

Article 3. Governing and Management Bodies

  1. 3.1 Assembly of Members
    1. 3.1.1 Shall be responsible for approving the rules of the Company.
    2. 3.1.2 All members with uninterrupted seniority in the Company of more than one year shall be considered full members with the right to vote.
    3. 3.1.3 The withdrawal from the Company shall automatically entail the loss of the status of assembly member, although, in the event of having applied for and been reinstated, one year after such reinstatement, the status of assembly member shall be acquired once again.
  2. 3.2 CEO
    1. 3.2.1 Shall be the representative of the Company before the corresponding bodies; shall manage the pertinent actions for the best operation and expansion of the Company and shall be responsible for the appointments of the members of the Staff of the Company as well as the coordination of the same.
  3. 3.3 Vice Presidents
    1. 3.3.1 Shall substitute the President in the event of his absence for any reason whatsoever.
  4. 3.4 Flight Operations Director
    1. 3.4.1 Shall be responsible for all technical operations of the Company. He shall manage the fleet of aircraft necessary for the normal development of flight operations and shall be responsible for the management of admissions and withdrawals of the Company, as well as the ratings of pilots proposed by the Instructors.
  5. 3.5 Chief of Territorial Operations Center
    1. 3.5.1 In coordination with the Flight Operations Director , he shall be responsible for the pilots assigned to his Center. He shall ensure compliance with the rules within his territorial area; he shall control the flight reports of the pilots of his territorial area, proceeding to their acceptance, modification or rejection. Promote, in coordination with the other C.T.O.'s, the actions considered necessary for a better development of the technical operability of the Company and shall be the first point of support for the new members; propose to the Operations Director the withdrawal of any of its members if necessary.
  6. 3.6 Flight Instructor
    1. 3.6.1 1 In coordination with the Director of Operations, he shall be responsible for the flight instruction of the fleet to which he has been assigned. He shall propose the rating of the pilot to the Director of Operations at the time he considers it appropriate.
  7. 3.7 Webmaster
    1. 3.7.1 Shall be ultimately responsible for the development, implementation and maintenance of the Company's management system and software. He shall provide the necessary tools for all members of the airline.
  8. 3.8 Events Manager
    1. 3.8.1 In coordination with the Webmaster and Flight Operations Director, shall be responsible for the creation of all non-scheduled flight operations which, due to tourist, calendar, or other interests, are intended to motivate the members of the Company. He shall be responsible for the coordination of external events with other Companies or IVAO.
  9. 3.9 Design and Corporate Image
    1. 3.9.1 Shall be responsible for the creation and/or maintenance of the corporate image. He shall also be responsible for the development of aircraft textures, MTLs, and everything related to this aspect.
  10. 3.10 Public Relations
    1. 3.10.1 Shall be responsible for the maintenance of the company's social networks, as well as for the publication of information deemed appropriate for the management of the Company's public image.

 

Article 4. Members

  1. 4.1 Members of the Company shall be all persons who, fulfilling the stipulated requirements and accepting the present regulations, show interest in belonging to the Company and are admitted.
  2. 4.2 Any IVAO user, regardless of nationality, shall have the right of access to the Company provided that he/she meets the requirements established for any member.
  3. 4.3 All members shall collaborate with the main objective of the Company. Collaboration is understood as the realization of at least 1 flight per month, of at least 40 minutes duration, under the callsign XAS that are duly reported, participation in events (in person and virtual) conducted by the company or any other way that helps in the general purpose of this company.
  4. 4.4 In the event of not being able to comply with the minimum activity for a justified reason, the user shall inform the President and/or the Chief of the relevant Territorial Operations Center, who may authorize, on an exceptional basis, his/her permanence in the Company for an additional month. If the estimated duration of inactivity is longer than one month, and up to a maximum of three months, the Flight Operations Director may exceptionally authorize the user to remain in the Company. If the estimated duration of inactivity exceeds three months, the Company Staff, with the report of the Flight Operating Director, shall decide on the continuation or withdrawal of the member.
  5. 4.5 Members shall ensure that they are able to receive communications from the Staff via email (avoiding emails from @alairvirtual.es being tagged as spam) or by visiting the forum or Discord on a regular basis.
  6. 4.6 If a member wishes to be removed from the company, he/she must communicate via email to the CEO or the Chief of the relevant Territorial Operations Center, who will process such withdrawal. From that moment the former member shall lose all the privileges he/she had. Privileges are understood as access to the IVAO VA System, the web, Whatsapp and Discord.
  7. 4.7 Likewise, a pilot may be removed from the company in the following cases:
    • - Own will, by sending an email to the CEO or to the corresponding CTO Chief.
    • - By inactivity, as described in section 4.3.
    • - When sanctioned by the flight network.
    • - When he/she commits a very serious misconduct.
    • - When the company management deems it appropriate for the proper functioning of the company (depending on the faults or penalties committed).
  8. 4.8 When a pilot has been withdrawn from Alair VA, the company undertakes to delete all the pilot's data, in compliance with current legislation on Data Protection.

 

Article 5. Registration of Pilots

  1. 5.1 The Alair Virtual Airlines membership is open to all members who, at the time of the application, are registered and active in the IVAO flight network.
  2. 5.2 To become a member of Alair VA it is mandatory to make an application through the form provided for this purpose on the website. This form will contain the following information: name and surname, email, city and country, date of birth, VID and flight hours.
  3. 5.3 Once admitted, the Company will assign a flight callsign and rank. For the determination of his rank, his flight hours as IVAO pilot will be validated at 75%.
  4. 5.4 In the event that the pilot needs to acquire the basic notions to enjoy flight simulation, he/she will be registered in the flight school and will be assigned an instructor.
  5. 5.5 The Alair Virtual Airlines Staff reserves the right to reject those applications that do not meet the requested requirements or are considered potentially dangerous for the image of the Company.

 

Article 6. Flight School

  1. 6.1 All students joining the Alair VA Flight School must, at all times, follow the instructions of their instructor and follow the pace set by him.
  2. 6.2 It is considered unacceptable to share the training received with other types of flights, other aircraft, other simulation networks or with callsigns belonging to other companies.
  3. 6.3 All training will be conducted in "offline" mode until the instructor considers that the student is ready to perform the exercises/flights in "online" mode.

 

Article 7. Flight Operations

  1. 7.1 All Alair Virtual Airlines pilots will perform their flights, subject to reports, "online and without jumps". Consequently, they will start their flights from the airport where they landed on their previous flight, regardless of the type of flight (scheduled or charter).
  2. 7.2 Flights shall be made online on the IVAO network except for those flights that, due to their training nature, are expressly authorized offline.
  3. 7.3 Scheduled flights
    1. 7.3.1 Alair Virtual Airlines will have a large number of scheduled flights for all types of aircraft.
    2. 7.3.2 Each flight plan will be assigned to an aircraft type in order to achieve efficient resource management.
    3. 7.3.3 In order to make a flight booking it is necessary for the pilot to be at an airport with at least one aircraft with a free flight plan.
    4. 7.3.4 The booked flight must be made within 48 hours, otherwise the system will automatically cancel the reservation.
    5. 7.3.5 These operations require the pilot's specific rating to operate the aircraft assigned to the flight line.
    6. 7.3.6 Aircraft ratings for scheduled flights shall be approved by the Flight Operations Director or, in his absence, by the member of the Staff to whom he has delegated.
    7. 7.3.7 These flights must be reported through the automated system developed by the company.
  4. 7.4 Charter Flights
    1. 7.4.1 All flights that do not correspond to a scheduled flight shall be considered charter flights.
    2. 7.4.2 All Alair Virtual Airlines pilots will be able to choose their "online" flight, subject to report, under the "charter" system; they will decide, by themselves, their destination airport, as well as the type of aircraft according to their ratings.
    3. 7.4.3 These flights shall be reported through the automated system developed by the company.
  5. 7.5 Flight Reports
    1. 7.5.1 The software developed for this purpose, Alair Pirep System (APS from now on), will be used to report flights.
    2. 7.5.2 The APS will take the relevant data from the simulator and transfer it to the Alair website or the VA System, as appropriate.
    3. 7.5.3 Any incident occurring during the flight, especially if there has been any disconnection during the flight, will be indicated in the comments section for a correct validation of the flight.
  6. 7.6 Ranks
    1. 7.6.1 Flight Student: Any pilot who enters without flight hours in IVAO and/or who needs to be registered in the school.
    2. 7.6.2 Private Pilot: Any pilot whose number of hours as a pilot, on the web, is between 50 and 99 hours.
    3. 7.6.3 Senior Private Pilot: Any pilot whose number of hours as a pilot, on the web, is between 100 and 249 hours.
    4. 7.6.4 Commercial Pilot: Any pilot whose number of hours as a pilot, on the web, is between 250 and 499 hours.
    5. 7.6.5 Senior Commercial Pilot: Any pilot whose number of hours as a pilot, on the web, is between 500 and 999 hours.
    6. 7.6.6 Airline Transport Pilot: Any pilot whose number of hours as a pilot, on the web, is between 1000 and 2499 hours.
    7. 7.6.7 Senior Airline Transport Pilot: Any pilot whose number of hours as a pilot, on the web, is between 2500 and 4999 hours.
    8. 7.6.8 Captain: Any pilot whose number of hours as a pilot, on the web, is between 5000 and 7499 hours.
    9. 7.6.9 Senior Captain: Any pilot whose number of hours as a pilot, on the web, is equal to or greater than 7500 hours.
    10. 7.6.10 Instructor: Only instructors shall hold this rank, regardless of the number of hours.
  7. 7.7 Fleet
    1. 7.7.1 Our Fleet is composed of:
      1. -Regional Fleet: piston, turboprop and short-range jets.
      2. -Medium Fleet: medium/long range jets.
      3. -Heavy Fleet: long range jets.
      4. -Vintage Fleet: classic aircraft.
  8. 7.8 Ratings
    1. 7.8.1 When a pilot wishes to obtain any rating, he/she will have to contact the corresponding instructor.
    2. 7.8.2 Upon completion of the relevant instruction, he/she will be required to perform such flights as the instructor deems appropriate to ensure that the pilot is proficient in that aircraft.
    3. 7.8.3 After such flights, if the instructor deems it appropriate, the instructor shall propose the pilot's rating to the Flight Operations Director.
    4. 7.8.4 Once the pilot is rated, he/she may perform regular flights with that type of aircraft.

 

Article 8. Misconducts and Penalties

  1. 8.1 Misconducts shall be classified as very serious, serious and minor.
  2. 8.2 The following shall be considered very serious misconducts:
    • Seriously disrespecting any person, whether he/she is or not a member of the company.
    • Transferring exclusive information to third parties without proper authorization.
    • Providing access passwords for any Alair VA media to people outside the company.
    • Repeatedly disregarding these rules or the decisions taken by the staff, provided that these decisions do not contravene the provisions of these rules.
    • Impersonate another member, either in the flight network, in the voice channel, in the Discord channel, by e-mail, or in any other way.
    • Repeatedly ignoring an attempt of communication from the staff. In case you plan to be absent for a prolonged period of time, you must notify in advance.
    • Report in Alair a flight made under another call sign, except for flights corresponding to tours or events in which it is mandatory to fly under a certain call sign that does not correspond to this company.
    • Maintain, repeatedly, attitudes harmful to the normal development of the company such as discussions, slander, defamation of colleagues..
    • Discutir de forma reiterada con otros miembros de IVAO, ya sea en frecuencia o no.
    • Accumulating 2 or more serious misconducts.
    • Those attitudes or actions that the staff considers that seriously damage and harm the image of the company, as well as the good atmosphere of this.
  3. 8.3 The following shall be considered serious misconduct:
    • Flying an unauthorized aircraft using Alair's callsign.
    • Willfully failing to comply with the instructions of an air traffic controller or disrupting the normal functioning of the network's flight operations.
    • Acumular 2 o más faltas leves.
    • Not respecting the rules of the company's communication channels, unless it is considered a very serious misconduct.
  4. 8.4 The following shall be considered minor misconducts:
    • Repeatedly filling out a flight plan incorrectly.
    • Repeatedly use of non-standardized phraseology.
    • Failure to follow the instructions of the instructor during the training or rating period.
  5. 8.5 Very serious misconduct may result in the following penalties:
      • Suspension for a period of 6 months to 2 years.
      • Expulsion from the company.
  6. 8.6 Serious misconduct may result in the following penalties:
      • Suspension for a period of 15 days to 3 months.
      • Withdrawal of the relevant rating.
  7. 8.7 Minor misconduct may result in the following penalties:
      • Reprimand.
  8. 8.8 Notwithstanding to the above points, any pilot who demonstrates that he/she does not have the necessary knowledge to perform flight operations correctly, may be proposed for re-entry to the school for further training.
  9. 8.9 In order to gather information about the seriousness of the infraction, as well as the severity of the sanction, a Disciplinary Committee shall be formed, which shall carry out the pertinent investigation and propose the sanction it deems appropriate.
  10. 8.10 It shall finally be the CEO who, with the report made by the Disciplinary Committee, shall take the decision it deems appropriate in view of the seriousness of the case.

 

CHAPTER III: ADDITIONAL REGULATIONS

Article 9. Additional Information

  1. 9.1 It shall be the responsibility of the pilot to keep themselves informed of news, changes in regulations, events, etc.
  2. 9.2 Ignorance of these regulations does not exempt from compliance.
  3. 9.3 The staff of the company is committed to publish all relevant and necessary information through any of the communication channels of the company, using one or more at a time.
  4. 9.4 In the event that any member of the company wishes to publish company information that may be considered private and/or exclusive, he/she must request the necessary permissions from the CEO.

 

Artículo 10. GDPR

  1. 10.1 The personal data of any member of the Company shall be private and for internal use, for communication purposes only, in accordance with the provisions of Law 15/1999, of December 13, 1999, on Data Protection.
  2. 10.2 Alair VA undertakes to maintain the privacy of the data provided by the pilots when registering with the company.
  3. 10.3 Alair VA undertakes to remove from its databases the data belonging to pilots whose withdrawal from the company has been processed and executed.

 

Article 11. Final Provisions

  1. 11.1 Notwithstanding the provisions of these regulations, the rules and regulations of IVAO, Discord, Ventrilo, and any other communication channel used by Alair VA shall also apply.
  2. 11.2 EIn cases that are not covered by these rules, the staff will make the decision that best fits the philosophy, vision and values of the Company.

 

Article 12. Publication

  1. 12.1 This policy shall enter into force at the time it is published on the Company's official website.
  2. 12.2 Any modification after its publication shall require the approval of a simple majority of the assembly of members of the company.
